Transient steals lighters and gets cited/released and trespassed, then arrested later for violation officers warning not to return

On Valentines Day at approximately 7:49 PM Steven Dwain Hardy, a transient from Butte Montana, was Cited & Released after he walked up to the front counter of the Texaco Convenience Store on S. Palo Verde and placed a few items into his pockets right in front of the store employee. The employee told Hardy to give the items back and leave, Hardy began cursing at him as he threw the items on the counter. The employee told Hardy if he did not leave he would call Police, Hardy told the employee he would give him a reason to call police and lef the store after taking three or four lighters off the display holder at the counter and walking out with them.

Officers made contact with Hardy who were unable to find the lighters in his possession at the time of their search. Due to his compliance with officers they Cited and Released him, then trespassed him from Texaco.

Officers were called back to Texaco at 8:46 PM after Hardy returned to the store after having just been trespassed. He was arrested for 3rd Degree Trespassing. Search Incident to arrested turned up three lighters in his shirt pocket which appeared to be brand new and never used. Those lighters were collected and returned to Texaco as recovered property.
